Therefore I am inclined to hold that persons empanelled as Drivers resjlts KSRTC are entitled to the benefit of clause 6 ii with respect to relaxation in the matter of upper age limit. On the basis of the observations contained hereinabove the competent authority in PSC is directed to take effective steps to scrutinise and declare selection of the petitioners depending on their eligibility.
P1 provides that, concession with respect to relaxation of upper age limit is provided to ‘provisional hands’ working in KSRTC.
In the said letter it is informed that KSRTC had recruited provisional Drivers only through Employment Exchange and those persons recruited through other source are very few in number and they are senior in provisional service.
By the circular the appointing authorities were directed to quote relevant rules while making appointment and promotions. It is pertinent to note that, for appointment under Rule 9 a i it is not insisted that such appointment should be on a continuous basis or on the basis of a pay scale or on payment of monthly salary. Sasidharan, learned standing counsel appearing for PSC submitted that what is intended in the counter affidavit is that, engagement as empanelled Drivers is not a provisional appointment in terms of Rule 9.
Provided further that the provisions of the proviso above mentioned shall not be applicable for the selection for admission to the Forest Rangers Course and also for admission to the Diploma Course in Forestry for which selections have to be made annually in accordance with the instructions of the Government of India issued from time to time.
